These Terms and Conditions set out how the bespokewelding.eu online shop works, how orders for made-to-order steel products are placed and handled, and the rights and obligations of the Seller and Customers. They apply from 16 October 2026.
1. Seller and contact
The online shop at bespokewelding.eu (the "Shop") is run by:
(the "Seller"). Email is the fastest way to reach us. We reply to messages within 24 hours on working days, and we confirm or decline Orders within 2 working days (section 6).
2. Definitions
- Customer: a natural person with full legal capacity, a legal person or an organisational unit that creates an Account or places an Order.
- Consumer: a Customer who is a natural person concluding a contract not directly related to their business or profession.
- Sole trader with consumer rights: a natural person running a business who concludes a contract directly related to that business but not of a professional nature for them (Article 7aa of the Polish Consumer Rights Act and Article 3855 of the Polish Civil Code). The provisions for Consumers on withdrawal, conformity of goods and unfair terms apply to them accordingly.
- Account: the Customer's personal account in the Shop, required to place an Order or to accept a Quotation.
- Working day: Monday to Friday, except public holidays in Poland.
- Order: the Customer's offer to buy Standard products at the prices and the delivery cost shown in the Shop, placed with the button "Order with an obligation to pay".
- Quotation: the Seller's offer sent by email for a Made-to-measure product, a site-built structure or delivery outside Poland other than courier delivery to Germany (section 8). It states the items and their specification, the prices, delivery or collection, the payment plan, the estimated time, its validity and, for each item, whether the right of withdrawal applies and, if it does, the cost of returning it (section 9, paragraph 8). A Quotation contains no bank details.
- Order Confirmation: the Seller's email that accepts an Order or confirms a Contract concluded by accepting a Quotation. It contains the Contract details, the amount due, the Seller's bank transfer details and the payment reference, and has these Terms and the model withdrawal form attached.
- Standard product: a product in the configuration described in the Shop (dimensions, material, finish), without changes requested by the Customer. The listed configuration of a site-built structure ordered unchanged through a Quotation is also a Standard product.
- Made-to-measure product: a non-prefabricated product made to the Customer's specification or adapted to the Customer's site, for example in dimensions, shape, material, finish or colour agreed individually. It is always ordered through a Quotation.
- Contract: the sales contract (or contract for goods to be manufactured) concluded between the Seller and the Customer under section 6.
3. Electronic services and technical requirements
- The Shop provides the following electronic services free of charge: the Account, the Order form, the online withdrawal function, enquiry and contact forms, the newsletter and product reviews.
- To use the Shop you need a device with internet access, an up-to-date web browser with JavaScript and cookies enabled, and an active email address.
- Customers must not submit unlawful content or use the Shop in a way that disrupts its operation.
- The Account agreement is concluded for an indefinite period. Customers may delete their Account at any time by emailing [email protected]. The Seller may terminate the Account agreement with 14 days' notice if the Customer seriously breaches these Terms.
- We send the newsletter only to people who have agreed to receive it. You can unsubscribe at any time using the link in the email or by writing to us.
- Only logged-in Customers can post product reviews. Every review is checked before publication. Reviews marked as a verified purchase come from Customers who have ordered the product. We do not publish sponsored reviews or commission reviews.
- Complaints about electronic services can be sent to [email protected]. We handle them within 14 days.
4. Registration
- You need an Account and must be logged in to place an Order.
- Customers provide accurate details and keep their password confidential. When buying for a business, the Customer provides the company details, including its tax identification number.
5. Products and prices
- We make every product after it is ordered. A Standard product is made in the configuration described on its product page. Photos and visualisations in the Shop show example versions; the product description states what you buy.
- Product and price information in the Shop is an invitation to enter into a contract (Article 71 of the Polish Civil Code), not an offer within the meaning of Article 66 of the Polish Civil Code. The Customer makes the offer by placing an Order (section 6).
- Prices are given in euro (EUR) and may be displayed in Polish zloty (PLN) or pounds sterling (GBP). Prices include all applicable taxes and do not include delivery, which is shown at checkout before the Order is placed.
- The prices and the delivery cost shown in the Shop when the Order is placed are binding. The Seller does not change them: it either accepts the Order at those amounts or declines it. For a Quotation, the prices in the Quotation are binding; for the listed configuration of a site-built structure, the Quotation uses the price shown in the Shop.
- Made-to-measure products and the site-built structures (steel mezzanines, the carport, staircases, the terrace canopy and the terrace pergola) are ordered through a Quotation, not through the Shop's checkout.
6. Orders and conclusion of the Contract
- A logged-in Customer adds Standard products to the cart, chooses collection from the Seller's workshop, delivery in Poland or, for products whose product page offers it, courier delivery to Germany, chooses bank transfer as the payment method, accepts these Terms and places the Order with the button "Order with an obligation to pay". Other delivery outside Poland is arranged through a Quotation (paragraph 6).
- Straight after the Order is placed, the Seller confirms its receipt by email. This receipt is not yet the acceptance of the Order and contains no bank details, so please do not pay on the basis of it.
- The Customer is bound by the Order until the end of the second working day after the day on which it was placed. Within that time the Seller either accepts the Order by sending the Order Confirmation or tells the Customer by email that it declines the Order, for example because the product cannot be made or delivered as ordered, or because the sale is not permitted under EU sanctions law. If the Order is declined, nothing is due.
- The Contract is concluded when the Order Confirmation reaches the Customer within the period in paragraph 3. Later copies of the same Order Confirmation do not change that moment.
- If the first Order Confirmation that reaches the Customer arrives after the period in paragraph 3, the Customer is no longer bound by the Order. That Order Confirmation is then the Seller's offer on the same terms, and the Contract is concluded when the Customer accepts it by a payment of the amount due that arrives within 7 days of receiving it. If no payment arrives within that time, the offer lapses and nothing is due.
- Made-to-measure products, the site-built structures and delivery outside Poland other than courier delivery to Germany are ordered through a Quotation. The Customer asks for one through the enquiry form on the product page or by email. A Quotation is valid for the period stated in it, at most 7 days. To accept it, the Customer, who needs an Account, replies by email within that period: "I accept quotation [number] and order with an obligation to pay". The Contract is concluded when that acceptance reaches the Seller. The Seller then records the Contract as an order in the Customer's Account and sends the Order Confirmation.
- The Order Confirmation confirms the Contract on a durable medium: it contains the Contract details, and these Terms (in the language of the Order and in Polish) and the model withdrawal form are attached as PDF files. If it does not arrive, write to [email protected] and we will send it again.
- The Customer is responsible for the accuracy of the dimensions and details they provide for a Quotation. Where anything is unclear, the Seller asks for confirmation before production starts.
7. Payment
- Payment is made by bank transfer to the account stated in the Order Confirmation. We give our account number only in the Order Confirmation and its copies, never on the website or in a Quotation. If you receive a message saying our account number has changed, contact us before making any payment.
- Standard products are paid in full within 7 days of receiving the first Order Confirmation, with the payment reference stated in it. Section 6, paragraph 5 applies to an Order Confirmation that arrives late.
- For a Made-to-measure product, the Customer pays a deposit of 50% of the price within 7 days of receiving the first Order Confirmation. The Seller then sends the technical drawing for approval. The remaining 50% is paid once the product is finished, before it is collected or shipped. The Seller informs the Customer by email when the product is ready and of the balance due.
- Production of a Standard product starts once the payment has been credited to the Seller's account. Production of a Made-to-measure product starts once the deposit has been credited and the Customer has approved the technical drawing.
- If a payment due under a concluded Contract has not arrived by its due date, the Seller reminds the Customer by email and, in that reminder, sets an additional period of 7 days for payment with a warning that, if the payment has not arrived by the end of that period, the Seller will be entitled to withdraw from the Contract. If the payment has still not arrived by then, the Seller may withdraw from the Contract (Article 491 § 1 of the Polish Civil Code) and tells the Customer by email; any amount received is refunded within 14 days.
- The Customer pays in the currency in which the Order was placed or the Quotation was issued (EUR, PLN or GBP), as stated in the Order Confirmation. Any charges made by the Customer's bank, including currency conversion, are borne by the Customer.
- On request, the Seller issues a sales document in accordance with applicable law.
- If the Seller cannot perform the Contract, all payments received are refunded without undue delay and no later than 14 days.
8. Production, pickup and delivery
- A Standard product ordered in the Shop is ready for collection within 7 weeks, or delivered in Poland or, by courier, in Germany within 9 weeks. These periods run from the Order, provided the payment arrives within 7 days of receiving the Order Confirmation; a later payment moves them by the delay. Where the Contract is concluded by payment under an Order Confirmation that arrived late (section 6, paragraph 5), they run from the day the payment arrives. The product page shows the latest dispatch date for an Order placed that day and confirmed in time. For a Quotation, the estimated time is stated in the Quotation.
- The Seller hands over or ships a Made-to-measure product once the balance of the price has been credited in accordance with section 7.
- Customers may collect their product in person from the Seller's workshop in Poland, whatever their address. Pickup is free of charge; the address and time are arranged by email.
- Delivery within Poland costs a flat rate by size, shown at checkout: parcel, pallet, or freight for long or oversize items. These rates never exceed 49 PLN for a parcel, 349 PLN for a pallet and 890 PLN for freight, or the equivalent in the currency of the Order. One rate is charged per Order; the checkout offers the rates suitable for every product in the cart. Larger products are shipped by pallet freight to the delivery address, without carrying inside, unless agreed otherwise.
- Products whose product page offers courier delivery to Germany are delivered to an address in Germany by parcel courier at a flat rate per Order shown on the Delivery page and at checkout, or its equivalent in the currency of the Order. The checkout offers this delivery when every product in the cart offers it.
- We also deliver to every other country. Delivery outside Poland other than courier delivery to Germany (paragraph 5) is priced individually in a Quotation (section 6).
- For deliveries outside the European Union, customs duties, import taxes and clearance charges may apply and are paid by the Customer unless the Quotation states otherwise.
- We recommend checking the shipment on delivery and recording any visible damage with the carrier. This does not limit a Consumer's rights.
- For Consumers, the risk of accidental loss or damage passes when the product is handed over to them. For other Customers, it passes when the product is handed over to the carrier.
9. Right of withdrawal and returns
- A Consumer may withdraw from a Contract for Standard products within 30 days without giving a reason. This extends the statutory 14-day period (Article 27 of the Polish Consumer Rights Act); the statutory rules on withdrawal apply to the whole 30-day period. If the last day falls on a Saturday, a Sunday or a public holiday in Poland, the period ends on the next working day.
- Under Article 38(1)(3) of the Polish Consumer Rights Act of 30 May 2014 (implementing Article 16(c) of Directive 2011/83/EU), there is no right of withdrawal from a Contract for non-prefabricated goods made to the consumer's specifications or clearly tailored to their individual needs. This covers Made-to-measure products: products made to dimensions, shape, material, finish or colour agreed individually with the Customer, or adapted to the Customer's site.
- Made-to-measure products cannot be returned. The Customer may, however, cancel a Contract for a Made-to-measure product free of charge until they approve the technical drawing, by email to [email protected]; the Seller then refunds the deposit in full within 14 days. Once the drawing is approved, the Contract can no longer be cancelled in this way. Rights for lack of conformity (section 10) are not affected.
- The checkout and the Delivery page state that Standard products can be returned within 30 days. The Quotation states for each item whether the right of withdrawal applies.
- The 30-day period runs from the day the Consumer, or a person they name other than the carrier, takes possession of the product, including collection at the workshop. The Consumer may also withdraw before taking possession of the product.
- To withdraw, it is enough to send a clear statement before the period ends. You can exercise your right of withdrawal online in your Account: on the Order history and details page or on the order's page, use the button "Withdraw from contract here", then "Confirm withdrawal". If you use this online feature, we will send you an acknowledgement of receipt of the withdrawal on a durable medium (by email), including its content and the date and time of its submission, without undue delay. You may also send any other clear statement, for example by email to [email protected], and you may use the model form at the end of these Terms, but you do not have to. Orders placed before 4 October 2026 do not have the online function; for them, please send your statement by email to [email protected].
- The Seller refunds all payments received, including the delivery cost (up to the cheapest standard delivery offered by the Seller), without undue delay and no later than 14 days after receiving the statement, using the same payment method unless the Consumer agrees to another method at no cost to them. The Seller may withhold the refund until the product has been received back or proof of its return has been supplied.
- The Consumer returns or hands over the product without undue delay and no later than 14 days after withdrawing. The Consumer bears the direct cost of the return. Because of their size and weight, products normally cannot be returned by post. For an Order placed through the Shop's checkout and delivered to the Customer, the cost of return equals the delivery price for the product's size (parcel, pallet or freight) to the country of delivery, as listed on the Delivery page when the Order was placed. Within Poland this is the flat delivery rate in section 8, paragraph 4, and for courier delivery to Germany the flat rate in section 8, paragraph 5. If a product ordered through the Shop's checkout was collected at the workshop, the Consumer brings it back to that workshop (ul. Akacjowa 56, 32-641 Piotrowice, Poland), on a working day agreed by email. The Seller charges nothing for accepting the return, and the Consumer bears only the cost of their own transport to the workshop, regardless of the country of their address. For a Contract concluded by accepting a Quotation, the cost of return is stated in the Quotation.
- The Consumer is liable for any reduction in the value of the product resulting from handling beyond what is necessary to establish its nature, characteristics and functioning.
10. Conformity of goods (Consumers)
- The Seller is liable to Consumers for any lack of conformity of the product with the Contract that exists at the time of delivery and becomes apparent within two years, under Chapter 5a of the Polish Consumer Rights Act.
- In the event of non-conformity, the Consumer may request repair or replacement and, in the cases provided by law, a price reduction or withdrawal from the Contract.
- Our products are made by hand from steel. Characteristics described in the product description or the Quotation, such as dressed weld marks, slight shade differences between coating batches or the natural patina of corten steel, form part of the agreed specification.
- Complaints can be sent by email to [email protected]. It helps if you describe the problem, attach photos and state what you are asking for. We reply within 14 days of receiving the complaint.
- The Seller bears the cost of repair, replacement and transport of the product for justified complaints.
11. Warranty for Customers who are not Consumers
- For Customers who are neither Consumers nor sole traders with consumer rights, the Seller's statutory warranty (rękojmia) under the Polish Civil Code expires one year after the product is handed over.
- The Seller's liability to these Customers is limited to the price paid for the product concerned and does not cover lost profits.
12. Out-of-court dispute resolution
- Consumers may use out-of-court complaint and redress procedures, for example a permanent consumer arbitration court or mediation by the regional Trade Inspection office, or free help from a municipal or district consumer ombudsman in Poland. Information is available at uokik.gov.pl.
- Consumers in other countries can get help from the European Consumer Centre in their country.
- The EU Online Dispute Resolution (ODR) platform was closed on 20 July 2025, so we do not link to it.
13. Personal data
How we process personal data is described in our Privacy Policy.
14. Final provisions
- Contracts concluded through the Shop are governed by Polish law. This choice of law does not deprive Consumers of the protection given by the mandatory provisions of the country where they habitually reside.
- Disputes with Customers who are neither Consumers nor sole traders with consumer rights are settled by the court having jurisdiction over the Seller's place of business.
- The Seller may amend these Terms for important reasons, in particular changes in the law or in how the Shop operates. Account holders are informed by email at least 14 days in advance. An Order is governed by the version in force when it was placed; a Contract concluded by accepting a Quotation is governed by the version in force when the Quotation was issued. The Order Confirmation has that version attached.
- These Terms are published in six languages. In case of discrepancies the Polish version prevails, without limiting the mandatory rights of Consumers.
